I know, I know – the créme de la créme of Fox News personnel didn’t cover this story.
But a few seconds on Google could have helped the junior staffer write a better article.
Contrary to the claims in the article, DeReu did not violate federal gun laws. She had an unloaded firearm stored in the locked trunk of her vehicle.
Title 18 U.S.C §922(q) The Gun Free School Zones Act of 1995 States:
(A) It shall be unlawful for any individual knowingly to possess a firearm that has moved in or that otherwise affects interstate or foreign commerce at a place that the individual knows, or has reasonable cause to believe, is a school zone.
(B) Subparagraph (A) does not apply to the possession of a firearm—
(iii) that is— (I) not loaded; and (II) in a locked container, or a locked firearms rack that is on a motor vehicle;
Nor did she violate Montana gun laws. They apply only to school buildings.
Fox took the clueless school superintendent at his word: that DeReu violated state and federal laws, and that the school could lose funding as a result. Nothing could be further from the truth.
There’s a whole lot of stupid in this story, but little, if any, comes from the 16 year old honor student.
